Crossing state lines with a minor
This weekend our Scout troop is driving to our summer camp location in another state. I'm assigned to drive my daughter plus one other girl. It's about a 8 hour drive.
The troop is being casual about driving arrangements. One leader will have all of the forms & such, but if I get pulled over, what do I need to have in my car that gives me permission to have this other girl in the car? |
Re: Crossing state lines with a minor
Interesting. I don't know of anything that I am aware of. I have driven both boy and girl scouts across state lines and didn't have anything in my car (the leader had all paperwork with her/him in that car).
If there is something I am interested to know the procedure. |
Re: Crossing state lines with a minor
Honestly, that would not be a worry on my mind at all. :shrug3

Re: Crossing state lines with a minor
As long as the leader has the parental consent and emergency contact forms I think legally you are fine but might be a good idea to have a copy of that info yourself since you are in different vehicles and not together as a group in a van

Re: Crossing state lines with a minor
Things must be a lot different in the States. It wouldn't cross my mind to be concerned if we went into Quebec with extra kids or if our kids were with others. The only thing I'd want to make sure they had was their provincial health card. Otherwise … :shrug
If we were crossing into the U.S. that would be a completely different thing. It came up with rep hockey and passports (obviously for all) and notarized letters are required for kids / teens travelling without their own parents. Are there issues crossing into different states? |

Well you *think* it wouldn't be a big deal, and I hope it wouldn't.
However, with sex trafficking going on, I would hope that I would be highly scrutinized if I were to be pulled over. And, I know that with custody issues, certain parents can't do certain things. So I'm thinking that if parents can't even cross state lines with kids in custody disputes, and I'm just a mere "parent volunteer," maybe I'd better just look into things! |
Re: Crossing state lines with a minor
I would absolutely make sure I had a note written and signed by the parent. I agree with PP about sex trafficking being a concern, and I also would just rather be safe than sorry in general and cover my own butt :shifty

Re: Crossing state lines with a minor
Well, here if a parent wants to fly alone with their own child it is best to bring a letter from the other parent stating knowledge and permission. Maybe something similar to ease your mind?

I would just *hope* that I would be scrutinized. But in my case, one girl in my car definitely doesn't look like my child!:D But even so, all of your kids would answer that they were yours. If she were questioned, she would answer that she wasn't mine, and then there is a potential issue. |

Re: Crossing state lines with a minor
You could ask for copies of the parental consent forms of the kids you have in your car. But I live on the border between two states and I and plenty of others drive kids who aren't our own across the state border all the time. It's not illegal all by itself. If someone does pull you over, the officer would be looking for signs before digging into which kids are whose. They can't ask all the questions all the time, when you get pulled over you don't always get asked to prove all the children belong to you or if you have drugs or if you've been drinking or if you have a weapon, etc. You only get asked those things when the officer notices a red flag or if they're out looking for that thing. So if it is a long drive where you might get separated or make multiple stops, sure see if you can get info for the child you have with you. Otherwise I wouldn't worry about it.

It is only if I get pulled over. I never get pulled over! LOL! I just want to be very prepared. I do not want to put myself in any position of question. This is me being protective mama bear. I certainly don't want anything to happen to me or to the girls in my care. I like to be prepared, and to me, this seems like a normal question. What paperwork do I need to have with me to transport this child across a state line? I guess not everyone thinks like me, but in my mind, this is as important as having my license and insurance card with me. ---------- Post added at 10:36 AM ---------- Previous post was at 10:34 AM ---------- Quote:
But I want to know the true legal requirements. What do I need to cover my butt!:) ---------- Post added at 10:36 AM ---------- Previous post was at 10:36 AM ---------- And yes, I will be asking for a copy of her health forms so that should an emergency arise, I do have authority over her emergency care. |
Re: Crossing state lines with a minor
There are no legal requirements. You need no paperwork. You would need something to make medical decisions for the child, but not to simply drive her across state lines. If you were to be pulled over, there is nothing you could be in trouble for. If the officer wanted to make it as difficult as possible, they would contact the parents, who would confirm that the child is riding with you to this place, and you would be let go. A child not being able to leave a state without written consent is the exception, not the rule.
